1. Aceptación de las condiciones

Al acceder o utilizar MenúHunter™ ("el Servicio"), usted acepta quedar obligado por estos Términos de Uso ("Términos"). Si no está de acuerdo con alguna parte de estos términos, no podrá acceder al Servicio.

1. Acceptance of Terms

By accessing or using MenúHunter™ ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you may not access the Service.

MenúHunter™ es una aplicación móvil y web que ayuda a los usuarios a descubrir menús del día de restaurantes en su zona. El Servicio permite a los usuarios explorar menús, guardar favoritos y a los propietarios de restaurantes gestionar la información de sus menús.

2. Description of Service

MenúHunter™ is a mobile and web application that helps users discover daily menus from restaurants in their area. The Service allows users to browse menus, save favorites, and for restaurant owners to manage their menu information.

3. Cuentas de usuario

3.1 Creación de cuenta

Para utilizar ciertas funciones del Servicio, debe crear una cuenta. Usted acepta proporcionar información precisa, actual y completa durante el registro y actualizar dicha información para mantenerla precisa, actual y completa.

3.2 Seguridad de la cuenta

Usted es responsable de mantener la confidencialidad de las credenciales de su cuenta y de todas las actividades que ocurran bajo su cuenta. Usted acepta notificarnos inmediatamente cualquier uso no autorizado de su cuenta.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

• Utilizar el Servicio para cualquier propósito ilegal o en violación de las leyes
• Subir, publicar o transmitir contenido dañino, ofensivo o que viole los derechos de otros
• Suplantar a cualquier persona o entidad o declarar falsamente su afiliación
• Interferir o interrumpir el Servicio o los servidores conectados al Servicio
• Intentar acceder sin autorización al Servicio o sistemas relacionados
• Utilizar sistemas automatizados para acceder al Servicio sin permiso

4. User Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload, post, or transmit any content that is harmful, offensive, or violates others' rights
• Impersonate any person or entity or falsely state your affiliation
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to the Service or related systems
• Use automated systems to access the Service without permission

5. Contenido y propiedad intelectual

5.1 Su contenido

Usted conserva la propiedad de cualquier contenido que envíe al Servicio. Al enviar contenido, nos otorga una licencia mundial, no exclusiva y libre de regalías para usar, reproducir, modificar y distribuir su contenido con el fin de operar y promover el Servicio.

El Servicio y su contenido original, características y funcionalidad son propiedad de MenúHunter™ y están protegidos por las leyes internacionales de derechos de autor, marcas registradas y otras leyes de propiedad intelectual.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the Service.

5.2 Our Content

The Service and its original content, features, and functionality are owned by MenúHunter™ and are protected by international copyright, trademark, and other intellectual property laws.

6. Términos para propietarios de restaurantes

Si es propietario de un restaurante que utiliza el Servicio para gestionar su menú:

• Usted declara tener la autoridad para gestionar el listado del restaurante
• Usted acepta proporcionar información de menú precisa y actualizada
• Usted acepta que los términos de suscripción se aplican según se describe en el Servicio
• Usted es responsable de mantener la calidad y exactitud de los datos de su menú

6. Restaurant Owner Terms

If you are a restaurant owner using the Service to manage your menu:

• You represent that you have the authority to claim and manage the restaurant listing
• You agree to provide accurate and up-to-date menu information
• You understand that subscription terms apply as described in the Service
• You are responsible for maintaining the quality and accuracy of your menu data

7. Términos de pago

Si adquiere una suscripción u otras funciones de pago:

• Todas las tarifas no son reembolsables salvo indicación contraria
• Las suscripciones se renuevan automáticamente a menos que se cancelen
• Nos reservamos el derecho de cambiar los precios con previo aviso
• Usted es responsable de los impuestos aplicables

7. Payment Terms

If you purchase a subscription or other paid features:

• All fees are non-refundable unless otherwise stated
• Subscriptions automatically renew unless cancelled
• We reserve the right to change pricing with notice
• You are responsible for any applicable taxes

8. Exclusiones de responsabilidad

EL SERVICIO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" SIN GARANTÍAS DE NINGÚN TIPO, YA SEA EXPRESAS O IMPLÍCITAS. NO GARANTIZAMOS QUE EL SERVICIO SERÁ ININTERRUMPIDO, SEGURO O LIBRE DE ERRORES.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.1 Información sobre menús, precios y disponibilidad

MenúHunter™ muestra información sobre menús, precios, disponibilidad, horarios de servicio y horarios de apertura obtenida de materiales disponibles públicamente y de contenido enviado por usuarios. MenúHunter™ no verifica de forma independiente dicha información.

Toda la información se proporciona "según disponibilidad" y puede estar incompleta, ser inexacta, estar desactualizada o estar sujeta a cambios sin previo aviso.

Los precios, detalles de los menús, horarios de servicio, disponibilidad del menú del día y horarios de apertura son determinados exclusivamente por el restaurante. MenúHunter™ no realiza declaraciones ni ofrece garantías sobre la exactitud, integridad, fiabilidad o vigencia actual de dicha información.

El usuario es responsable de confirmar directamente con el restaurante los precios, la disponibilidad y los horarios antes de realizar un pedido o acudir al establecimiento.

8.1 Menu and Price Information

MenúHunter™ displays menu information, pricing, availability, serving times, and opening hours that are sourced from publicly available materials and user-submitted content. MenúHunter™ does not independently verify such information.

All information is provided on an "as available" basis and may be incomplete, inaccurate, outdated, or subject to change without notice.

Prices, menu details, serving times, menú del día availability, and opening hours are determined solely by the restaurant. MenúHunter™ makes no representations or warranties regarding the accuracy, completeness, reliability, or current validity of such information.

Users are responsible for confirming pricing, availability, and opening hours directly with the restaurant prior to ordering or visiting.

9. Limitación de responsabilidad

En la máxima medida permitida por la legislación aplicable, MenúHunter™ no será responsable de daños indirectos, incidentales, especiales, consecuenciales o punitivos, ni de pérdidas de beneficios, ingresos, fondo de comercio, datos o uso, derivados de o relacionados con el uso o la imposibilidad de uso del Servicio.

Sin perjuicio de lo anterior, nada en estas Condiciones excluye o limita la responsabilidad de MenúHunter™ por (i) dolo o fraude, (ii) negligencia grave, (iii) muerte o daños personales causados por negligencia, o (iv) cualquier otra responsabilidad que no pueda excluirse o limitarse legalmente. Asimismo, lo anterior se entiende sin perjuicio de los derechos irrenunciables de los consumidores conforme a la normativa aplicable.

Cuando MenúHunter™ sea responsable conforme a la legislación aplicable, dicha responsabilidad quedará limitada al importe efectivamente pagado por el usuario a MenúHunter™ (si lo hubiera) durante los doce (12) meses anteriores al hecho que dio lugar a la reclamación, salvo que la ley establezca otro límite o no permita aplicar esta limitación.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MenúHunter™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, goodwill, data, or use, arising out of or relating to the use of, or inability to use, the Service.

Notwithstanding the foregoing, nothing in these Terms excludes or limits MenúHunter™'s liability for (i) fraud or willful misconduct, (ii) gross negligence, (iii) death or personal injury caused by negligence, or (iv) any other liability that cannot be excluded or limited by law. This is without prejudice to mandatory consumer rights under applicable law.

Where MenúHunter™ is liable under applicable law, such liability shall be limited to the amounts actually paid by the user to MenúHunter™ (if any) in the twelve (12) months preceding the event giving rise to the claim, unless applicable law provides otherwise or does not permit this limitation.

10. Terminación

Podemos terminar o suspender su cuenta y acceso al Servicio de inmediato, sin previo aviso, por conducta que consideremos que viola estos Términos o es perjudicial para otros usuarios, nosotros o terceros.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Cambios en los Términos

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Notificaremos a los usuarios de cualquier cambio material. Su uso continuado del Servicio después de dichas modificaciones constituye la aceptación de los Términos actualizados.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
